1. Agreement to Terms
By accessing cofield.digital or apply.cofield.digital (the "Sites") or using Cofield Digital's services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Sites.
2. Services
Cofield Digital provides digital marketing services to residential roofing contractors, including website development, local search engine optimization, AI search optimization, and automated lead capture systems. Specific deliverables and terms are set out in individual client agreements.
3. Eligibility
You must be at least 18 years old and the owner or authorized decision-maker of a business to submit an application through our funnel or engage our services.
4. Application Process
Submitting an application through apply.cofield.digital does not guarantee acceptance as a client. We reserve the right to decline applications at our discretion.
5. SMS Messaging Program
When you submit an application through apply.cofield.digital and check the SMS consent checkbox, you opt in to receive SMS text messages from Cofield Digital.
Description of the program: The SMS program is transactional in nature. Messages include application confirmations, appointment reminders for scheduled consultation calls, follow-ups regarding your submitted application, and direct communications related to your engagement with Cofield Digital. We do not send promotional or marketing SMS messages through this program.
Message frequency: Message frequency varies based on your application status and any scheduled appointments. You may receive several messages in the days following your application, then occasional messages related to upcoming appointments.
Message and data rates: Message and data rates may apply. Standard message and data rates from your wireless carrier will apply to all messages sent and received. Cofield Digital is not responsible for any charges from your wireless carrier.
How to opt out: You can opt out at any time by replying STOP to any text message you receive from us. After replying STOP, you will receive one final confirmation message and will not receive further SMS messages from Cofield Digital. You may opt back in at any time by contacting us.
How to get help: Reply HELP to any text message for assistance, or email hello@cofield.digital.
Carrier liability: Cofield Digital is not liable for any delays or failures in the receipt of any SMS messages, as delivery is subject to effective transmission from your wireless carrier and is outside our control. Wireless carriers are not liable for delayed or undelivered messages.
Supported carriers: SMS messaging is supported on all major US wireless carriers including AT&T, T-Mobile, Verizon, and Sprint. Carriers are not liable for delayed or undelivered messages.
6. Intellectual Property
All content on our Sites, including text, graphics, logos, and design elements, is owned by or licensed to Cofield Digital and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our permission.
7. User Conduct
When using our Sites, you agree not to:
- Submit false or misleading information
- Interfere with the operation of the Sites
- Attempt to gain unauthorized access to any part of the Sites
- Use the Sites for any unlawful purpose
8. Disclaimers
Our Sites and services are provided "as is" without warranties of any kind. We do not guarantee specific results from our services beyond what is stated in individual client agreements.
9. Limitation of Liability
To the fullest extent permitted by law, Cofield Digital is not liable for any indirect, incidental, special, or consequential damages arising from your use of our Sites or services.
10. Privacy
Your use of our Sites is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is available at cofield.digital/privacy and is incorporated into these Terms by reference.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our Sites after changes constitutes acceptance of the updated Terms.
